Beef and Beer Raises more than $3,000 for the Dayna Lynne Sperring Memorial Scholarship Fund

On September 30th, Dayna's mother Renee, with the help of family and friends, hosted the 1st Annual Dayna Lynne Sperring Memorial Scholarship Fund Beef and Beer.

The event raised more than $3,000 to be awarded to a senior at Dayna's alma mater, Springford High School planning to pursue a career in Childhood Education or Nursing; the two fields that Dayna had wanted to pursue.

The Scholarship will be presented by Dayna's youngest brother, Christopher, to one of his fellow classmates at graduation this summer.

Words cannot begin to express the gratitude Renee feels in her heart for every single person who worked so hard to make this event such a huge success. She hopes to make this an annual event.

From Death to Worse

Much time has passed since this blog has been updated; mostly because we, Dayna's family have yet to have been afforded the opportunity to grieve in peace.

As if Dayna and Damon's death were not a big enough blow, Dayna's husband took over where Mr. Do left off.

Two weeks following her death, her husband got himself a new live in girlfriend, took up crack, and stole approximately $1500 from Dayna's grieving grandmother's bank account. It seems that court documents in his possession contained copies of cancelled checks (checks that paid the rent on several occasions). The slimebag and his girlfriend used the routing and account numbers on those checks to pay off her cell phone bill, obtain a prepaid VISA card and pay for visits to pornographic websites. Oh, and he also tried to scam Dayna's bank by "depositing" $400.00 and trying to withdrawl immediately after. Problem? The envelope was empty. Thank God for video surveillance. He and his girlfriend were arrested. Both spent time in jail but not nearly enough. He was released on September 20.

While in jail, he and his scumbag attorney sued Dayna's grandmother's auto insurance for death benefits. (Dayna was driving her grandmother's car at the time of her death.) He received $50,000 of which his scumbag lawyer took his 1/3 . The rest was prompted distrubuted in several checks to his daughter (obviously to take it out of his name so that he couldn't lose it in a lawsuit.) Dayna's mother had long since petitioned the court for control of her estate. (Did I mention that her mother asked her scumbag husband only for Dayna's collection of porcelain dolls and was denied? ) Any monies received by the estate were to have been frozen until the petition was heard and a decision was rendered by the courts. Apparently, the lawyer thought he was above the law. He was ordered to make full disclosure of all dispersements within 30 days and to repay Dayna's grandmother and pay the funeral home. No one has seen their money.

Want more? $50,000 apparently wasn't enough. They sued the auto insurance AGAIN for another $50,000 for the death of Dayna's unborn child. The fetus was no more than 23 weeks. But they were able to find a "medical expert" to say that the fetus would have been viable. Though the insurance company fought hard, they had no choice but to issue another check for $50,000. And still, Dayna's grandmother has not been repaid what was stolen from her, nor has the funeral home been paid.

The family continues it's pursuit for some form of justice. It's likely to be several more years before all suits are filed and settled.

Dayna's husband is out on parole in the Reading area.

STUPIDITY IS NOT A CRIME MR. DO, SO YOU'RE FREE TO GO

At 1:15 today, Son Quang Do, got his day in court. While Dayna's family sat in a waiting room, Mr. Do was quickly whisked by them and taken to a private room where he would wait, not having to face us, until the hearing began. While he was being "counseled" in his private room, the family was also being counseled, BY THE POLICE. Told by the police to make sure they were "cordial" and "civil" and basically not to make a scene, they were treated more like the criminal than the family of the victim. In fact, Dayna's uncle was overheard calling someone an asshole and was immediately confronted by a police officer who "didn't appreciate" his comment. Mr. Do entered the court room, plead guilty to summary charges of exceeding the posted speed limit, driving in an unmarked lane of the highway and driving without insurance. He will lose his license for 90 DAYS, pay fines of $336.00 and...........oh yeah........I guess in an effort to "throw the family a bone" he will be held responsible for the storage charges of the car Dayna was driving due to impounding. Until now, Dayna's 65 year old grandmother has been hounded by the garage for payment. Mr. Do showed NO REMORSE, there was NO APOLOGY OR ACKNOWLEDGMENT TO THE FAMILY. And when it was all over, 10 minutes after it was started, my family and the media were ordered to leave the area, being told that they would not allow Mr. Do to leave the court until they were gone.

According to the Montgomery County District Attorney, the difference between ORDINARY Recklessness/Negligence and GROSS Recklessness/Negligence is the presence of a "Bad Mental State" and Son Quang Do didn't have that when he PLOWED into the back of Dayna's car and broke her neck.

What is a Bad Mental State Mr. D.A.?

Examples we received were: driving in excess of 100 mph, drag racing on the highway, backing down an on or off ramp. But NOT driving at 70 mph on the shoulder of the road.

The bottom line is that Mr. Do was CARELESS, STUPID, INATTENTIVE, SHOWED POOR JUDGEMENT, none of which are criminal acts.

Alcohol, we're told, was not a factor. The results of his Blood Alcohol Test was "ZERO". Hard to believe that absolutely NO ALCOHOL would show in his blood when he admitted to consuming "LESS THAN A BEER" (give me a break). Could it be that the blood wasn't drawn until 3 hours after the accident? Could it be that the blood transfusions he received tainted the results?

What was a factor was a NEGLIGIBLE curve in the road beginning about 500 feet from where Dayna's car was stopped. According to the First Assistant D.A., from Mr. Do's vantage point, that curve made it appear to him that Dayna was in a marked lane, not on the shoulder. DID HE NOT SEE HER FLASHING LIGHTS???????

The D.A. repeatedly assured us that he would love to be able to file criminal charges in this case but, because of the way the law is written, he wouldn't be able to make the charges stick. It's not enough to just kill someone with your car. You have to be found to have had malintent or to have had a SEVERE disregard for the possible consequences of your actions.

When we asked what we could do to change the laws we were told that we could go to the state legislature, who would be sympathetic, but that the fight would have to go all the way to the Supreme Court who interprets the law. We got the impression from the D.A. that it would never be changed.

AN ACT

Amending Title 75 (Vehicles) of the Pennsylvania Consolidated Statutes, further providing for homicide by vehicle.

The General Assembly of the Commonwealth of Pennsylvania hereby enacts as follows:
Section 1. Section 3732 of Title 75 of the Pennsylvania Consolidated Statutes is amended to read:

3732. Homicide by Vehicle

Any person who (unintentionally) RECKLESSLY OR WITH GROSS NEGLIGENCE causes the death of another person while engaged in the violation of any law in this Commonwealth or municipal ordinance applying to the operation or use of a vehicle or to the regulation of traffic except section 3731 (relating to driving under the influence of alcohol or controlled substance) is guilty of homicide by vehicle, a [misdemeanor of the first] felony of the third degree, when the violation is the cause of death.

Section 2. This act shall take effect in 60 days.
